Feiten
I.c. gaat het om een zaak tussen het college van burgemeester en wethouders van Eindhoven (appellant) en de betrokkene. Bij besluit van 17 september 2013, gehandhaafd bij besluit van 24 januari 2014 (bestreden besluit), heeft het college op de bijstand van betrokkene een maatregel toegepast die inhoudt dat de bijstand met 40% over de maand september 2013 wordt verlaagd.
De rechtbank heeft het beroep tegen het bestreden besluit gegrond verklaard, dat besluit vernietigd, het besluit van 17 september 2013 herroepen en bepaald dat haar uitspraak in de plaats treedt van het vernietigde besluit. Het college heeft zich in hoger beroep tegen de aangevallen uitspraak gekeerd.
Het hoger beroep is namens het college B&W ingesteld door mr. I. van der Zijden, medewerkster bij de afdeling bezwaar, beroep en klachten (BBK), die ook namens appellant het hoger beroepschrift heeft ondertekend. Betrokkene heeft in zijn aanvullend verweerschrift naar voren gebracht dat enkel de betrokken wethouder bevoegd is tot het instellen van hoger beroep en dat niet is gebleken dat deze bevoegdheid is ondergemandateerd.
Centrale Raad van Beroep
Het college van burgemeester en wethouders van Eindhoven is op grond van artikel 8:104 van de Awb het bestuursorgaan dat bevoegd is tot het instellen van hoger beroep tegen de uitspraak van de rechtbank. Het betrokken bestuursorgaan is in dit geval appellant.
Er is mandaat verleend en het sectorhoofd is bevoegd tot het verlenen van ondermandaat. Nu aan mr. Van der Zijden, niet zijnde het hoofd of het plaatsvervangend hoofd van die afdeling, geen (onder)mandaat tot het instellen van hoger beroep is verleend, was zij niet bevoegd namens appellant hoger beroep in te stellen. Het hoger beroep is niet bevoegdelijk ingesteld en moet daarom niet-ontvankelijk worden verklaard.
Het hoger beroep is niet bevoegdelijk ingesteld. De Centrale Raad van Beroep verklaart het hoger beroep niet-ontvankelijk.
