CAO. Nawerking algemeen verbindend verklaarde bepalingen (AVV).
Art. 32, 67 en 68 van de CAO Motorvoertuigen- en Tweewielerbedrijf.
De heer Beenen was krachtens arbeidsovereenkomst werkzaam als pomphouder op een benzinestation bij Vanduho. In 1984 werd Beenen arbeidsongeschikt en bleef dit tot het einde van zijn arbeidsovereenkomst. Tijdens het eerste jaar van zijn ziekte kreeg Beenen een uitkering op grond van de Ziektewet. Daarna kreeg hij een WAO-uitkering. Beenen viel onder de CAO voor het Motorvoertuigen- en Tweewielerbedrijf. Een aantal bepalingen uit deze CAO is algemeen verbindend verklaard. Deze bepalingen zijn van toepassing op de arbeidsovereenkomst tussen Beenen en Vanduho. De werkgever is verplicht om de werknemer tot 24 maanden na arbeidsongeschiktheid salaris door te betalen, mits dit buiten zijn schuld om is gebeurd. Beenen vordert aanvulling van de doorbetalingen tot 100% van zijn salaris.
Als een werknemer arbeidsongeschikt wordt op een moment waarop de AVV bepalingen van toepassing zijn dan behoudt hij de aanspraak van loondoorbetaling gedurende 24 maanden. Dit geldt ook indien de AVV-bepalingen niet gedurende de volledige 24 maanden van toepassing zijn. Het verkregen recht van 100% doorbetaling van het loon wordt dus niet aangetast als tijdens die 24 maanden de AVV-bepalingen niet meer van toepassing zijn.
De Hoge Raad verwijst het geding naar het Hof en veroordeelt Vanduho in de kosten.
