Casus
Is sprake van een verstoorde arbeidsverhouding, dan kan zich de situatie voordoen dat de werknemer zich op grond van (dreigende) psychische of lichamelijke klachten niet in staat acht tot het verrichten van zijn werkzaamheden, hoewel ten aanzien van de arbeidsgeschiktheid geen medische beperkingen van psychische of fysieke aard kunnen worden vastgesteld, zodat van arbeidsongeschiktheid ten gevolge van ziekte in de zin van artikel 7:629 BW geen sprake is. Dit wordt wel aangeduid als ‘situatieve arbeidsongeschiktheid’. In hoeverre kan in zo’n geval worden gezegd dat de werknemer zijn werkzaamheden niet heeft verricht door een oorzaak die in redelijkheid voor rekening van de werkgever behoort te komen in de zin van artikel 7:628 lid 1 BW?
Hoge Raad
De werknemer die zich erop beroept dat hij als gevolg van situatieve arbeidsongeschiktheid zijn werkzaamheden niet heeft verricht en over de betrokken periode doorbetaling van zijn loon vordert, zal feiten en omstandigheden moeten stellen en zo nodig aannemelijk moeten maken die tot het oordeel kunnen leiden dat in die periode de arbeidsomstandigheden, door een oorzaak die in redelijkheid voor rekening van de werkgever behoort te komen, voor hem zodanig waren dat, met het oog op de (dreiging van) psychische of lichamelijke klachten, van hem redelijkerwijs niet kon worden gevergd dat hij zijn werkzaamheden zou verrichten.
De werknemer is in een zodanig geval in beginsel gehouden alle medewerking te verlenen aan inspanningen die erop gericht zijn de oorzaken daarvan weg te nemen. De werknemer behoudt dan ingevolge artikel 7:628 BW zijn recht op loon en werkweigering kan dan geen ontslaggrond vormen.
