Feiten
Tussen P. en Hema is overeengekomen dat de dienstbetrekking van P. zal eindigen per 30 september 1995. P. zal per 1 oktober van zijn werkgever een aanvulling op zijn sociale zekerheidsuitkering ontvangen. Op 29 juli 1995 ontdekt men twee flessen motorolie in de auto van P., die onbetaald bij Hema zijn meegenomen. Hierop ontslaat Hema P. op staande voet en stelt dat zijn niet langer gebonden is aan de overeengekomen regeling.

Is hier sprake van opgaaf van een dringende reden?
Hoge Raad
Een dringende reden voor de werkgever bestaat voor de werkgever in daden, eigenschappen of gedragingen van de werknemer die ten gevolge hebben dat van de werkgever niet gevergd kan worden de dienstbetrekking te laten voortduren. Hiertoe moeten de omstandigheden van het geval in aanmerking genomen worden, zo ook de persoonlijke omstandigheden van de werknemer.
De Rechtbank had bij haar oordeel de volgende omstandigheden in aanmerking moeten nemen:
1. Het meenemen zonder betaling gebeurde feitelijk op zijn laatste werkdag (hij ging op vakantie).
2. Eerdere vergrijpen waarvan Hema P. heeft beschuldigd zijn niet vast komen staan.
3. Met ontslag op staande voet ontvalt het recht op de overeengekomen regelingen.
4. P. heeft in feitelijke instantie verklaard dat het financieel nadeel dat hij ondervindt door het ontslag op staande voet in geen verhouding staat tot het vergrijp dat hem toegerekend wordt.
