Ontlopen TV door onregelmatige opzegging? (Ktr. Breda 30-06-2016, AR 2016-0728)
Feiten
I.c. had de werkgever een ontslagprocedure gevoerd bij UWV. Hij had hierbij toestemming gekregen om de arbeidsovereenkomst op te zeggen. Echter de procedure bij UWV had langer geduurd dan de werkgever had verwacht, omdat UWV aanvullende informatie had opgevraagd en een extra ronde van hoor en wederhoor was ingelast. Hierdoor was de procedure vertraagd. Doordat dit allemaal langer duurde kon de werkgever (gezien de opzegtermijn) de arbeidsovereenkomst niet te laten eindigen vóórdat de werknemer 24 maanden in dienst was. Met andere woorden; de daadwerkelijke ontbinding zou plaatsvinden nadat de werknemer 24 maanden in dienst was en dan zou de werknemer recht hebben op een transitievergoeding. Om dit te voorkomen heeft de werkgever de arbeidsovereenkomst opgezegd met een korte termijn. Hierdoor was de arbeidsovereenkomst beëindigd exact 1 dag voordat de werknemer 2 jaar in dienst was. Zodoende zou de werkgever geen transitievergoeding hoeven betalen.
Rechtbank
Is de werkgever alsnog een transitievergoeding verschuldigd, ondanks het feit dat de arbeidsovereenkomst door deze actie van de werkgever formeel geen 24 maanden had geduurd?
De rechter stelt dat de werkgever de transitievergoeding moet betalen, die bij opzegging met inachtneming van de juiste opzegtermijn verschuldigd zou zijn. Dit wordt gebaseerd op de strekking van het wetsartikel over de wettelijk verplichte transitievergoeding en het goed werkgeverschap.
Kern
Een onregelmatige opzegging (zonder inachtneming van de geldende opzegtermijn) waardoor de arbeidsovereenkomst korter dan 24 maanden zal duren, kan niet het recht van de werknemer op een transitievergoeding (die bij een regelmatige opzegging verschuldigd zou zijn) teniet doen. Het trucje van de werkgever werkt dus niet.
