New Hairstyle (HR 30-06-2017, ECLI:NL:HR:2017:1187)
Casus
Een kapper had een vast dienstverband bij New Hairsyle voor 4,5 uur per week. Na een discussie over het opnemen van vakantiedagen, probeerde New Hairstyle dit dienstverband te beëindigen middels een vaststellingsovereenkomst zonder financiële vergoeding. De kapster stemde nier niet mee in. Een jaar later probeerde New Hairstyle, zonder succes, een ontslagvergunning te krijgen van het UWV. Na een nieuw conflict heeft New Hairstyle uiteindelijk (na 25 dienstjaren) de arbeidsovereenkomst opgezegd; zonder er acht op te slaan of dit juridisch mogelijk was. De kapster kreeg een transitievergoeding van € 1.596,00 bruto. Kapster verzocht om een vergoeding van € 57.699,07 bruto.
Hoge Raad
De Hoge Raad oordeelt dat de wetgever als doel had om te bepalen wat billijk is voor de werknemer. De wetgever heeft geen punitatief karakter aan de billijke vergoeding toe willen kennen.
De wet geeft geen uitsluiting over de berekening van de billijke vergoeding; er is ook geen minimum of maximumbedrag vastgesteld. De Hoge Raad oordeelt in dit arrest dat werknemers recht hebben op een geïndividualiseerde berekening van de billijke vergoeding.
In casu gaat het om een vernietigbare opzegging van de arbeidsovereenkomst; de kapster had ervoor kunnen kiezen (art. 7:681 lid 1 BW) om om een billijke vergoeding te verzoeken i.p.v. de opzegging te vernietigen. Volgens de Hoge Raad kunnen de gevolgen van een zo'n ontslag niet in alle gevallen volledig worden gecompenseerd door een transitievergoeding.
Bij het bepalen van de billijke vergoeding kan gelet worden op:
- Het bedrag dat de kapster verdiend zou hebben als de opzegging van de overeenkomst vernietigd zou zijn. Het zal van de omstandigheden van het geval afhangen welke verdere duur van de arbeidsovereenkomst daarbij in aanmerking moet worden genomen.
- Of de arbeidsovereenkomst ook op rechtmatige wijze beëindigd had kunnen worden (en op welke termijn).
- De duur van het dienstverband.
- De gevolgen van het ontslag.
- Of de werknemer inmiddels al ander werk geeft gevonden (en welke inkomsten de werknemer daaruit geniet) en (andere) inkomsten van de werknemer die hij in redelijkheid in de toekomst kan verweven.
Bij de begroting van de billijke vergoeding komt het dus aan op alle omstandigheden van het geval.
