Schending gemeenschapsrecht. Vrije verkeer van goederen, art. 30 en 34 VEU.
Casus
In Oostenrijk vond er een demonstratie plaats tegen de vervuiling van het milieu door het toenemende vrachtverkeer in het land. Hierbij werd gedurende 30 uur een belangrijke doorstroomroute geblokkeerd, waardoor het Duitse transport bedrijf Schmidberger gedurende deze periode zijn transporten niet kon vervoeren. Dit zou in strijd zijn met het recht van het vrij verkeer van goederen, welke de interne markt van de gemeenschap moet bevorderen.
Rechtsvragen
Is een, door bevoegde autoriteiten goedgekeurde, samenkomst waarvoor een weg voor langere tijd gesloten is een schending van gemeenschapsrecht wanneer het een belemmering vormt voor het vrije verkeer van goederen? (r.o. 47, prejudiciële vragen)
Is deze schending te rechtvaardigen door beroep op fundamentele mensenrechten als vrijheid van meningsuiting en vergadering, die zo een legitieme doelstelling van algemeen belang vormen?
HvJ
In eerste aanleg werd het beroep van Schmidberger verworpen op de grond dat er geen sprake was van langdurige belemmering en opstoppingen. De instantie waar het hoger beroep werd ingediend, richtte zich tot het Hof van Justitie. Het Hof stelt dat er wel sprake was van een belemmering en dus schending van het recht voor het vrije verkeer van goederen. Echter werd deze gerechtvaardigd door de fundamentele mensenrechten vrijheid van meningsuiting en recht van vergadering, vastgelegd in het EVRM. De omstandigheden van het geval brachten mee dat de staat voldoende duidelijk is geweest over de mogelijk belemmeringen. Ook oordeelt het Hof dat er geen sprake was van langdurige belemmeringen. Het doel van de demonstranten was niet het vrachtverkeer belemmeren. Oostenrijk heeft een voldoende evenwichtige afweging gemaakt tussen het te beschermen gemeenschapsrecht en het legitieme doel om dit recht te kunnen beperken.
Leerstuk
Het gemeenschapsrecht moet worden nageleefd en brengt een verplichting mee tot handelen van de overheid van de lidstaten. Toch is er voldoende beoordelingsruimte aan de zijde van de nationale overheid.
