Gourmet (Case C-405/98) - Arrest
Gourmet (HvJ 08-03-2001, Zaak C-405/98)
Het is op basis van Zweedse regelgeving verboden in tijdschriften te adverteren voor alcoholhoudende dranken (>2,25% alcohol). Op grond van deze regelgeving stelde de KO een vordering in tegen Gourmet, omdat zij in haar blad had geadverteerd voor whiskey en rode wijn.
Hof
Er werden prejudiciële vragen gesteld, waarmee werd gevraagd of de verdragsbepalingen m.b.t. het vrije verkeer van goederen in de weg staan aan een verbod op reclame voor alcoholhoudende dranken. De nadelige invloed van het reclameverbod op de verkoop van alcoholhoudende dranken is toegegeven door de KO en de regeringen, omdat de Zweedse regelgeving de alcoholconsumptie wil verminderen.
De KO en de regeringen stellen dat in dit geval niet aan de voorwaarden van het arrest Keck is voldaan, zodat er geen sprake is van belemmering voor de handel tussen de lidstaten.
Wanneer nationale bepalingen de toegang tot de markt voor producten uit een andere lidstaat niet verhinderen of meer bemoeilijken dan voor nationale producten het geval is, valt iets niet binnen de werkingssfeer van art. 30 EG. Het reclameverbod verbiedt iedere vorm van reclame voor het product. Het effect van dit verbod is voor de internationale dranken verdergaander dan voor de nationale dranken, waarmee de consument reeds bekend is.
Er zijn bovendien andere mogelijkheden, zoals redactionele reclame, waarbij in de tekst reclame wordt gemaakt voor dergelijke producten. Dit is wél toegestaan. Het Hof is van mening dat het reclameverbod een maatregel is welke de handel in producten uit andere lidstaten sterker beïnvloedt dan de handel in nationale producten. Zij vorm tevens een belemmering voor de handel tussen lidstaten die binnen de werkingssfeer van art. 30 EG valt. Alleen wanneer men de volksgezondheid wil beschermen, is er sprake van een rechtvaardiging.
