Casus
In 1991 was Verkooijen woonachtig in Nederland en in loondienst van een in Nederland gevestigde BV, waarvan de aandelen middellijk worden gehouden door een NV gevestigd en België en aldaar aan de beurs genoteerd. Verkooijen verwierf aandelen in de NV waarvoor hij dividend uitgekeerd kreeg. Daarop werd 25% Belgische bronbelasting ingehouden. In de Nederlandse belastingaangifte heeft Verkooijen het dividend bij zijn belastbare inkomen opgegeven. Omdat dit niet aan het Nederlandse belastingstelsel was onderworpen kreeg Verkooijen een aanslag van de belastinginspecteur. Verkooijen is van mening dat dit niet kan en dient bezwaar in. Uiteindelijk wordt door de staatssecretaris van financiën cassatie ingesteld. Daar stellen ze prejudiciële vragen aan het Hof. Het Hof zal moeten beantwoorden of de richtlijn die toepassing geeft aan artikel 67 van het verdrag in de weg staat aan een dergelijke regel.
Uitspraak
Het Hof is van mening dat door een dergelijke bepaling onderdanen van een lidstaat die in Nederland wonen ervan worden afgeschrikt om hun kapitaal te beleggen in vennootschappen die gevestigd zijn in een andere lidstaat. De bepaling heeft ook een dergelijk restrictief gevolg voor in andere lidstaten gevestigde vennootschappen, in zoverre zij hen belemmert in het bijeenbrengen van kapitaal in Nederland. Aangezien de door hen uitgekeerde dividend aan Nederlandse ingezetenen fiscaal ongunstiger worden behandeld dan de door een in Nederland gevestigde vennootschap uitgekeerde dividenden, zijn hun aandelen voor de in Nederland wonende belegger minder aantrekkelijk dan die van in die lidstaat gevestigde vennootschappen.
Rechtsregel
Wanneer de toekenning van een fiscaal voordeel als de dividendvrijstelling bij de heffing van inkomstenbelasting van natuurlijke personen/aandeelhouders afhankelijk gesteld van de voorwaarde, dat de dividend afkomstig zijn van op het nationale grondgebied gevestigde vennootschappen, dan vormt dit een verboden beperking van kapitaalverkeer.
