Casus
In Frankrijk zijn er twee verschillende motorrijtuigenbelastingen. De eerste wordt geheven op motorrijtuigen met een fiscaal vermogen van 16 pk of minder. De tweede wordt geheven op motorrijtuigen met een fiscaal vermogen van meer dan 16 pk. De eerste belasting heeft een progressief tarief dat gelijkmatig stijgt naar mate van het vermogen van het motorrijtuig. De tweede belasting heeft een vast tarief, maar dit ligt aanzienlijk hoger dan dat van de eerste belasting. In 1981 kocht belanghebbende (de heer Humblot) een motorrijtuig met een fiscaal vermogen van 36 pk. Hierover moest hij 5000 Franse francs belasting betalen. Na betaling vorderde Humblot het verschil tussen dit bedrag en het hoogste bedrag van de eerste progressieve belasting terug, te weten 1100 francs. De vraag was of artikel 95 EEG-Verdrag aan een dergelijke heffing in de wet stond.
Overwegingen HvJ EG
In Frankrijk werden motorrijtuigen van meer dan 16 pk niet geproduceerd. In feite betekende dit dat er onderscheid werd gemaakt tussen nationale en ingevoerde motorrijtuigen. Volgens de Franse Staat mocht deze belasting wel worden geheven omdat het alleen gaat om luxe motorrijtuigen. Echter, volgens de rechtspraak van het Hof zijn alle motorrijtuigen gelijk, ongeacht hun fiscale vermogen. Dit onderscheid mag alleen worden gemaakt indien er objectieve criteria zijn. Het Franse criterium van fiscaal vermogen is geen economisch motief voor de heffing van de belasting. Onder die omstandigheden zou de bijzondere (hoogste) belasting in strijd zijn met art. 95 EEG-Verdrag. Wel zijn lidstaten volgens het Hof vrij om motorrijtuigen te onderwerpen aan een progressieve verkeersbelasting. Echter, in casu is sprake van differentiatie omdat alle ingevoerde motorrijtuigen altijd met de hoge belasting te maken krijgen en alle nationale voertuigen met de lage belasting. De belasting beperkt de mededinging en is in strijd met het beginsel van neutraliteit van binnenlandse belastingen.
Uitspraak
De heffing van een dergelijke belasting is in strijd met art. 95 EEG-Verdrag.
