Josemans is de eigenaar van de coffeeshop 'Easy Going' in Maastricht. Om drugstoerisme tegen te gaan is er een APV in werking gesteld die het verbied om aan niet Nederlanders drugs te verkopen. Het blijkt dat Josemans dit toch doet en de coffeeshop wordt gesloten. Meneer Josemans gaat hier tegenin en procedeert tot aan de Raad van State met het argument dat het verbod om drugs aan niet-Nederlanders te verkopen indirecte discriminatie is.
De Raad van State besluit prejudiciële vragen te stellen aan het Europese hof. Een van deze vragen is onder andere of deze zaak überhaupt onder het verdrag valt en zo ja of hier sprake is van discriminatie.
Rechtsgang
European Court of Justice: Het begint ermee dat hoewel het belangrijkste verkooppunt van een coffeeshop drugs is er ook non-alcoholische dranken en eten wordt verkocht. Deze verkopen worden gezien als secundaire inkomsten van de coffeeshop.
Een uitbater van een coffeeshop kan geen beroep doen op het principe van vrij verkeer van goederen, als het drugs betreft. De non-alcoholische dranken en het eten vallen onder het verlenen van diensten aangezien dit over het algemeen in de coffeeshop zelf genuttigd wordt. Hierbij is dan ook art. 56 ev. TFEU van toepassing.
Hoewel de vrijheid van diensten van toepassing is kan de maatregel die genomen is door de burgemeester van Maastricht toch toegestaan zijn ivm de publieke orde. Omdat door drugs grote overlast veroorzaakt wordt en er geen mogelijkheid is om de niet-Nederlanders wel in de coffeeshop toe te laten om eten en drinken te halen, maar geen drugs is het sluiten van de coffeeshop de enige oplossing geweest. Hoewel dit in strijd is met het vrij verkeer van diensten is dit toch toegestaan omdat het hier het bestrijden van drugstoerisme betreft. Daarnaast is de maatregel proportioneel.
Conclusie
In dit arrest is een bredere interpretatie gegeven van de publieke orde uitzondering. Hoewel het vrij verkeer van diensten betreft is beperking hiervan toch toegestaan om drugstoerisme te bestrijden en overlast tegen te gaan.
