Casus
Het gaat om een geschil tussen een Griekse radio en televisie-omroeponderneming (ERT) en een door de gemeente onderhouden nieuwsdienst (DEP). ERT is opgericht bij wet. ERT heeft tot taak het organiseren, exploiteren en ontwikkelen van radio en televisie en een bijdrage te leveren aan de informatie, de cultuur en de verstrooiing van het Griekse volk, alles zonder winst als oogmerk te hebben. De ERT heeft exclusieve rechten verkregen op dit gebied, zij is van mening van DEP en de burgemeester van Thessaloniki zich met hun activiteiten hebben begeven op het terrein van hun exclusieve rechten. ERT vorderde daarom een verbod op iedere verdere uitzingen van DEP en daarnaast inbeslagname en sekwestratie van de technische uitrusting. DEP en de burgemeester verdedigen zich met een beroep op het gemeenschapsrecht en op het Europees verdrag.
Uitspraak
Het Hof stelt dat het gemeenschapsrecht zich er niet tegen verzet dat om niet-economische redenen van openbaar belang een televisiemonopolie wordt toegekend. De inrichting en uitoefening van dat monopolie mogen echter niet in strijd zijn met het de verdragsbepaling die strekken tot bescherming van het vrije verkeer van goederen en diensten en met de mededingingsregels. Dan zegt het Hof dat artikel 59 EEG-verdrag zich verzet tegen een nationale regeling die voor de exclusieve rechten tot uitzending van eigen programma’s en tot doorgifte van programma’s uit andere lidstaten een monopolie instelt, wanneer een dergelijk monopolie discriminerende gevolgen heeft ten nadele van programma’s uit andere lidstaten. Tenzij die regeling gerechtvaardigd is op een van de gronden van artikel 56, die verwijst naar artikel 66 van het verdrag.
Rechtsregel
De grenzen van de bevoegdheid van de lidstaten om toepassing te geven aan de artikelen 66 en 59 EEG-verdrag om redenen van openbare orden, openbare veiligheid en volksgezondheid, moeten worden beoordeeld aan de hand van het algemene beginsel van vrijheid van meningsuiting, zoals neergelegd in artikel 10 van het Europees verdrag tot bescherming van de rechten van de mens.
