Nefalit/Erven Karamus (HR 31-03-2006, NJ 2011/250)
Casus
Eiseres tot cassatie, Nefalit B.V. beschikt over een fabriek in de gemeente Hof van Twente. Hier heeft jarenlang een werknemer, genaamd Karamus, gewerkt. Gedurende de jarenlange dienst van Karamus, werd hij veelvuldig blootgesteld aan asbest, wat een gevaarlijke stof is, als men hiermee in aanraking komt. Asbest kan namelijk de luchtwegen van de mens beschadigen. Ongeveer twee decennia nadat Karamus gestopt was met werken bij Nefalit B.V. werd er longkanker geconstateerd bij Karamus. Na een aantal jaren bleek echter dat Karamus niet was opgewassen tegen deze ziekte, waardoor hij het leven liet. De familie van Karamus dacht dat deze ziekte was veroorzaakt door de jarenlange blootstelling aan asbest, waardoor ze Nefalit B.V. aansprakelijk stellen. Nefalit B.V. geeft weliswaar aan dat Karamus jarenlang is blootgesteld aan deze stof, maar geeft als tegenargument dat Karamus voor een periode van 28 jaar heeft gerookt. Deze slechte gewoonte van Karamus heeft de longkanker ook kunnen veroorzaken.
Het hof
Het gof geeft in het hoger beroep aan dat de Nefalit B.V. als werkgever verplichtingen had op grond van art. 7:658 BW. Uit lid 1 van dit artikel blijkt namelijk dat de werkgever verplicht is om lokalen, werktuigen en gereedschappen, waarmee arbeid wordt verricht, dusdanig te onderhouden, dat de werknemer die hiervan gebruik maakt geen schade zal lijden. Het Hof geeft daarentegen ook aan dat het causale verband tussen de blootstelling aan asbest en de longkanker niet kan worden bewezen. Toch heeft de werkgever wel degelijk bijgedragen aan het ontstaan van de longkanker, omdat zij niet voldoende maatregelen heeft getroffen om de werknemer te beschermen tegen de asbest. Het hof vindt dat Nefalit B.V. daarom een schadevergoeding moet betalen, verminderd met de kans dat het rookgedrag de longkanker ook had kunnen veroorzaken op grond van art. 6:101 BW.
Hoge Raad
De Hoge Raad oordeelde dat als er sprake is van een beperking om vast te stellen in hoeverre welke partij aansprakelijk is voor de schade, er een deskundige moet worden ingeschakeld. In casu werd er een deskundige ingeschakeld, die bepaalde dat Nefalit B.V. voor 55% aansprakelijk was voor het ontstaan van de longkanker. De Hoge Raad gaf aan dat Nefalit B.V. hierdoor 55% aan schadevergoeding moest betalen. Aangezien Karamus zelf ook heeft bijgedragen aan het ontstaan van de longkanker door zijn rookgedrag, is de 45% eigen toedoen van de schadevergoeding afgetrokken. Op deze manier wordt er dus een evenredige verdeling gemaakt.
