Ongerechtvaardigde verrijking (huidige 6:212)
Is een vergoedingsplicht wegens ongerechtvaardigde verrijking mogelijk? (Ten tijde van dit arrest en het oude BW bestond dit nog niet.)
Batelaan is apotheekhoudend huisarts. Adriani wil zich in die plaats vestigen als apotheker. Krachtens de Wet op de Geneesmiddelenvoorziening (WG) wordt de vergunning van de huisarts dan ingetrokken. De WG rept niet over een vergoeding voor de huisarts, maar de beroepsorganisaties achten deze op zijn plaats en hebben enkele richtlijnen hierover uitgevaardigd. A. doet B. een aanbod van vergoeding, maar B. slaat dit af. Vervolgens wordt de vergunning van B. ingetrokken. Alsnog wil B. dan het aanbod van A. aanvaarden, maar deze stelt dat dit is komen te vervallen. Vervolgens stelt A. een actie uit ongerechtvaardigde verrijking in.
Past vordering B in het Nederlandse rechtsstelsel? Er bestaan publiekrechtelijke wetten (o.a. Wet Autovervoer Personen) die een vergoedingsplicht kennen voor schade die is ontstaan door wetten uitgevaardigd door de staat wegens het algemeen belang. Dus past vordering B. in het Nederlandse rechtsstelsel.
Dat de WG zelf die mogelijkheid niet kent, doet hier niet aan af. Omdat er geen enkele reden is waarom A. de patiënten van B. kosteloos mocht overnemen, is een vergoedingsplicht op haar plaats. De voorzienbaarheid van het intrekken van de vergunning van B. betekent niet dat B. ook rekening diende te houden met het feit dat hij geen vergoeding zou krijgen.
