Casus
Deze casus gaat over de ontslagname van een werknemer die geestelijk gestoord is. De werknemer en zijn gemachtigde beweren dat het ontslag vernietigbaar is, omdat de werknemer wegens een psychiatrische stoornis niet in staat was zijn wil te bepalen. De werkgever in kwestie heeft de arbeidsovereenkomst opgezegd, verkerende in het vertrouwen dat de werknemer zijn ontslag heeft gewild. De werknemer beroept zich op art. 3:34 BW, in de veronderstelling dat er verband bestaat tussen de stoornis en het ontslag. De werkgever beroept zich op art. 3:35 BW, in de veronderstelling dat hij erop kon vertrouwen dat zijn werknemer ook werkelijk zijn ontslag gewild heeft, en daardoor de arbeidsovereenkomst inderdaad vernietigd is en er geen verdere betaling plaats hoeft te vinden. De feitelijke instanties moeten beoordelen of de werkgever op grond van art. 3:35 BW er vanuit mocht gaan dat de werknemer ontslag wilde nemen.
Hoge Raad
De werkgever verklaart dat hij niet had kunnen veronderstellen dat de werknemer onder invloed van een geestelijke stoornis zijn wil betuigde. Dit vertrouwensbegrip gaat in dit geval echter niet op. Het gaat hier om het naar objectieve maatstaven redelijkerwijze niet voorzienbare nadeel. Met andere woorden: aangezien de werkgever de wil van zijn werknemer toch al in twijfel trok, had hij er beter voor kunnen kiezen zijn werknemer niet te ontslaan, met name omdat hij daar toch geen nadeel van had ondervonden. De werkgever was verzekerd tegen dergelijke situaties waardoor hij in geen van beide gevallen in een nadelige situatie terecht was gekomen: wel of geen ontslag. De werknemer ondervond echter wel degelijk nadeel van zijn ontslag. De werkgever moet de bedragen die de werknemer is misgelopen daarom aan hem uitkeren. Kortom; als er geen nadeel bestaat voor de persoon die zich vol vertrouwen veronderstelde, bijvoorbeeld omdat diegene hierdoor geen hogere kosten zal maken, is de vertrouwensleer niet van belang.
