Veedfald/Arhus Amtskommune (HvJ EG 10-05-2001, zaak C-203/99)
Casus
Veedfald diende een niertransplantatie te ondergaan. Nadat de nier bij de donor was verwijderd werd zij met het oog op de transplantatie gespoeld met een daarvoor bestemde infusievloeistof. De vloeistof vertoonde gebreken, zodat een van de bloedvaten van de nier bij de spoeling verstopt raakte en de nier ongeschikt werd voor transplantatie.
De vloeistof is bereid in het laboratorium van de apotheek van een ander ziekenhuis, het Arhus Ambtskommune. Met een beroep op art. 371 vordert Veedfald schadevergoeding van de Ambtskommune. Deze wijst elke aansprakelijkheid af en wijst erop dat zij het product niet in het verkeer heeft gebracht.

Hof
Dat een producent het product niet in het verkeer heeft gebracht ziet met name op gevallen waarin een ander dan de producent het product uit het productieproces wegneemt of indien het product tegen de wil van de producent wordt gebruikt. Deze uitzondering moet volgens het Hof eng worden uitgelegd. Volgens het Hof is een product ook in het verkeer gebracht, als het ziekenhuis waar het is gemaakt niet heeft verlaten en het voor het gebruik van het product kenmerkend is, dat de persoon voor wie het is bestemd zichzelf naar die controlesfeer moet begeven.
Dat producten worden vervaardigd voor een bepaalde medische dienstverrichting, die niet rechtstreeks door de patiënt wordt betaald, maar wordt bekostigd uit openbare middelen afkomstig van de belastingbetaler, doet niet af aan de economische en beroepsmatige aard van de vervaardiging van producten. Het betreft immers geen gratis verrichte activiteit die als zodanig onder de uitsluiting van art. 6:185 lid 1 sub c BW valt.
Dat de vaststelling van de precieze inhoud van de beide categorieën schade van art. 6:190 lid 1 BW (dood of lichamelijk letsel dan wel beschadiging of vernietiging van een privé zaak) aan de nationale wetgever is overgelaten, neemt niet weg dat, met uitzondering van onstoffelijke schade waarvan de vergoeding uitsluitend door het nationale recht wordt geregeld, er voor beide categorieën van schade een billijke en volledige vergoeding van de door een gebrekkig product veroorzaakte schade moet worden toegepast. De toepassing van nationale regels mag namelijk geen afbreuk doen aan het nuttig effect van de richtlijn.
Bovendien moet de nationale rechter uitleggen in het licht van de bewoordingen en het doel van de richtlijn. Een lidstaat kan dus geen beperkingen stellen aan de te vergoeden categorieën van stoffelijke schade als gevolg van dood, lichamelijk letsel of privé zaakschade. Hof wijst de vordering toe.
