Oerlemans/Driessen - Arrest
Oerlemans/ Driessen (HR 27-04-2001, RvdW 2001, 96)
Casus
Driessen exploiteert een rozenkwekerij. Hij heeft van Oerlemans een meststof gekocht en geleverd gekregen. Dit heeft hij toegediend aan zijn rozenplanten waarna de groei van de planten sterk terugliep. Vervolgens heeft Driessen een vordering tegen Oerlemans ingesteld, met de grondslag dat Oerlemans jegens haar wanprestatie dan wel een onrechtmatige daad gepleegd heeft door een meststof te leveren die herbicide bevatte waardoor ernstige schade is ontstaan.
Hoge Raad
Als uitgangspunt geldt dat de meststof niet aan de overeenkomst beantwoordde. Er is dus sprake van een tekortkoming in de nakoming van de overeenkomst, die op grond van art. 6:74 BW tot schadevergoeding verplicht, tenzij de tekortkoming niet aan de schuldenaar kan worden toegerekend. Oerlemans heeft het product niet zelf geproduceerd, het gaat om een gebrek dat geheel buiten haar toedoen is ontstaan en dat zij kende noch behoorde te kennen.
De tekortkoming is dus niet aan haar schuld te wijten en deze komt ook niet krachtens de wet of rechtshandeling voor haar rekening. De vraag of de tekortkoming aan Oerlemans moet worden toegerekend, moet dus aan de hand van verkeersopvattingen worden opgelost (art. 6:75 BW).
De verkeersopvattingen brengen mee dat een tekortkoming bestaande in een gebrek van een verkocht product in beginsel voor rekening van de verkoper komt, ook als deze het gebrek niet kende of behoorde te kennen. Dit is slechts anders in het geval van bijzondere omstandigheden. Deze mogen echter niet snel worden aangenomen.
