Dit arrest gaat over de psychosomatische verschijnselen bij een moeder na dood van een kind. Art. 1406 BW brengt mee dat aansprakelijkheid voor de onderhavige psychosomatische schade, als veroorzaakt door de dood van het kind is uitgesloten. Beoordeling van de vordering op de grondslag van art. 14O7 zou tot gevolg hebben dat eiseres als moeder van het overleden kind aanspraak zou hebben op vergoeding van andere schade dan waarvoor art. 1406 aan de daar bedoelde nabestaanden vergoeding toekent.
Feiten
Eiseres heeft geen succes gehad met haar vordering tot betaling van ƒ 9000 als vergoeding van immateriële schade die zij stelt te hebben geleden als gevolg van een aanrijding. De aanrijding vond plaats tussen een door haar bestuurde auto en een andere auto waarbij zij zelf lichte lichamelijke letsels opliep maar haar toen bijna 2-jarig dochtertje, dat achterin de auto van eiseres in een kinderzitje zat, werd dodelijk verwond. Vast staat dat uitsluitend de bestuurster van de andere auto, die ten onrechte aan eiseres geen voorrang gaf, schuld heeft aan de aanrijding en ter zake daarvan aansprakelijk is. De door eiseres gestelde schade is het gevolg van een aantal psychosomatische verschijnselen die zich na het ongeval bij haar hebben voorgedaan. In r.o. 5 heeft het Hof geoordeeld dat te dezen niet art. 1407 maar art. 1406 BW toepasselijk is, welke laatste bepaling slechts voorziet in vergoeding van schade voor zover het betreft gederfd levensonderhoud, dat eiseres als ouder door de arbeid van haar nedergeslagen kind placht te ontvangen. In cassatie gaat het om deze kwestie: is in deze zaak inderdaad uitsluitend art. 1406 BW toepasselijk?
Uitspraak
Uitgaande van de feiten van het Hof, heeft het Hof terecht geoordeeld dat art. 1406 BW meebrengt dat aansprakelijkheid voor de onderhavige schade van psychosomatische aard, als veroorzaakt door de dood van het kind, is uitgesloten. Een andere opvatting, als door het middel in al zijn onderdelen verdedigd en erop neerkomende dat de onderhavige vordering op grondslag van art. 1407 moet worden beoordeeld, zou tot gevolg hebben dat eiseres als moeder van het overleden kind aanspraak zou hebben op vergoeding van andere schade dan waarvoor art. 1406 aan de daar bedoelde nabestaanden vergoeding toekent, met name vergoeding van de door de dood van het kind geleden immateriële schade. Dit is volgens de Hoge Raad niet met de strekking van art. 1406 verenigbaar.
