Schadevergoeding & Absolute competentie
Is de Afdeling Bestuursrechtspraak bevoegd om kennis te nemen van een verzoek om schadevergoeding.
Een bedrijf stelt schade te hebben geleden door een, in haar ogen, onrechtmatig genomen besluit van de minister van Infrastructuur en Milieu en vraagt om schadevergoeding van €25.000; hoewel zij stelt dat de feitelijke schade meer dan €165.000 is. Het bedrijf houdt zich het recht voor om de schade die uitstijgt boven de €25.000 te vorderen bij de burgerlijk rechter. De minister van Infrastructuur en Milieu stelt dat alleen de burgerlijk recht bevoegd is om deze vordering te beoordelen.
Artikel 8:89 Awb gaat over de bevoegdheidsverdeling tussen de bestuursrechter en de burgerlijk rechter bij onrechtmatig bestuurshandelen, art. 8:88 Awb. Volgens lid 2 is de burgerlijk rechter exlusief bevoegd als de gevorderde schadevergoeding meer dan €25.000 is. Na het instellen van een vordering bij de burgerlijk rechter, is het niet meer mogelijk om de vordering aan de bestuursrechter voor te leggen.
De ABRvS stelt dat zij bevoegd is, omdat art. 8:89 lid 2 Awb de mogelijkheid om twee redenen beperkt:
De gestelde schadeoorzaak dient onder art. 8:88 Awb te vallen.
De vordering bedraagt maximaal €25.000.
De Awb stelt niet dat de eiser nadrukkelijk afstand moet hebben gedaan van zijn vordering voor het bedrag boven de €25.000. De Awb wijkt op dit punt af van de artikelen 94 en 95 van het Wetboek van Burgerlijke Rechtsvordering.
