Rechtsvraag
1) Mag de staat ook gebruik maken van privaatrechtelijke bevoegdheden tot behartiging van haar belang indien haar reeds daarvoor bevoegdheden zijn toegekend bij een publiekrechtelijke regeling (tweewegenleer)?
2) Mag de Staat in de onderhavige casus als eigenaar een financiële vergoeding verlangen, ondanks de WVO?
Casus
De fabrikant Windmill loost gipsslurry op de Nieuwe Waterweg. De Staat is eigenaar van de Nieuwe Waterweg. Windmill heeft alle vergunningen op grond van publiekrechtelijke wetten, waaronder de Wet verontreiniging oppervlaktewateren (WVO). Deze wet reguleert de lozingen op oppervlaktewateren door deze activiteit te onderwerpen aan een vergunningsregiem en aan een heffing. Op grond van de WVO verlangt de Staat geen heffing, maar hij verlangt wel als eigenaar dat Windmill een financiële vergoeding betaalt voor het lozen. Windmill weigert dat, waarop de Staat hem voor de burgerlijke rechter daagt. In kort geding wordt het staken van de lozingen gevorderd.
Hoge Raad
1a. Beslissend hiervoor is of die publiekrechtelijke regeling in deze kwestie zelf voorziet.
1b. Zo nee, dan is beslissend of gebruik van de privaatrechtelijke bevoegdheden die regeling op onaanvaardbare wijze doorkruist. Hierbij is o.a. van belang: inhoud en strekking van de regeling (die mede kan blijken uit haar geschiedenis) en de wijze waarop en de mate waarin in het kader van die regeling de belangen van de burgers zijn beschermd, een en ander tegen de achtergrond van het geschreven en ongeschreven publiekrecht.
1c. Van belang is voorts of de overheid met de publiekrechtelijke regeling een vergelijkbaar resultaat kan bereiken (dan is geen plaats voor de privaatrechtelijke weg) (het lijkt erop dat dit derde punt pas aan de orde komt, als de publiekrechtelijke niet op onaanvaardbare wijze doorkruist wordt; m.a.w. ook als er geen vergelijkbaar resultaat is, kan de privaatrechtelijke weg zijn afgesneden; zie ook r.o. 3.5).
2. Nee. Aan de WVO-vergunning mag een financiële vergoeding niet als voorschrift worden verbonden. De WVO kent daarnaast een heffingsregeling, waarin de belangen van de burgers op zorgvuldige wijze beschermd worden: grondslag en maatstaf geregeld in wet, uitwerking in AMvB, rechtsbescherming via algemene belastingwetgeving, wettelijke bevoegdheidsverdeling binnen de overheid, coördinatie.
Deze heffingsregeling wordt daarom bij gebruikmaking van de privaatrechtelijke weg op onaanvaardbare wijze doorkruist.
