Vrij verkeer van personen
De Philipijnse Mary Carpenter is gehuwd met een Engelsman. Zij verblijft in het Verenigd Koninkrijk ook nadat haar vergunning verlopen is en zij het land moet verlaten. Nationale wetgeving bevat een bepaling, inhoudende dat een persoon die geen Brits onderdaan is uit het Verenigd Koninkrijk kan worden gezet.
Ze beroept zich op art. 49 EG. Scheiding van Mary en haar man zou schade berokkenen aan het hun toekomende recht op ´family life´, ex art. 8 lid 1 EVRM. Met het verzoek haar het land te laten verlaten wordt dus een inbreuk op dit recht gemaakt. Van uitzonderingen die gemaakt kunnen worden als het belang van de openbare orde in het geding is, is hier geen sprake.
De man van Mary is dienstverrichter in het Verenigd Koninkrijk. Hij is dus vrij om te gaan en staan waar hij wil binnen de grenzen van de gemeenschap. Het hof is van mening dat het discriminatieverbod zich ook uitstrekt tot een echtgenoot van een dienstverrichter, onderdaan van een derde land. Het uitsluiten van een vrouw uit een land waar haar echtgenoot woont, vormt dus een inbreuk op haar vrijheid.
Slechts om redenen van openbaar belang kan afbreuk aan dit recht gedaan worden. Inmenging zou niet evenredig zijn met het nagestreefde doel, namelijk het recht op eerbiediging van het gezinsleven in het licht van art. 8 lid 1 EVRM.
Mary Carpenter mag dus blijven in het Verenigd Koninkrijk
