Zutphense Waterleiding (HR 10-06-1910, W 1910, 9038)

Casus

Nijhof, een handelaar in lederwaren, gebruikte voor de opslag van zijn waren de begane grond van een pakhuis. Op een nacht sprong de waterleiding en Nijhof kon de hoofdkraan niet afsluiten omdat deze zich boven in het pakhuis, in een woonhuis, bevond. De bewoonster weigerde het verzoek om de kraan dicht te draaien. Toen de politie erbij werd geroepen om de bewoonster te overreden om de kraan dicht te draaien, was het al te laat: de lederwaren waren onherstelbaar beschadigd.

Nijhof stelde vervolgens tegen de bewoonster een vordering tot schadevergoeding in o.g.v. art. 1401 en 1402 BW. Art. 1402 BW luidde: ‘een ieder is verantwoordelijk, niet alleen voor de schade, welke hij door zijen daad, maar ook voor die welke hij door zijne nalatigheid of onvoorzichtigheid veroorzaakt heeft.’

Rechtsvraag

Was de bewoonster nalatig in de zin van art. 1402 BW?

Hoge Raad

De wet kent nergens een verplichting tot hulpverlening. De bewoonster was dan ook niet nalatig in de zin van art. 1401 en 1402 BW en er was ook geen sprake van een inbreuk op Nijhofs eigendomsrecht op de lederwaren. De HR heeft in eerdere arresten beslist dat voor een dergelijke inbreuk enige activiteit vereist was. Dit was bij de bewoonster geheel niet het geval. Conclusie: het beroep van Nijhof op art. 1401 en 1402 faalde. Zodoende moest hij zelf voor de schade aan zijn lederwaren opdraaien.
