Feiten
I.c. ging het om een geding tussen de Firma C. Schwarze uit Bremen en het Bureau voor de invoer en de opslag van granen en veevoeder uit Frankfurt. De aanleiding was een conflict over het uitvoeren van geoogste producten en het vrije verkeer.
Het Hessische finanzgericht richt zich tot het Hof van Justitie met een prejudiciële vraag. Niet zozeer omdat het uitleg van het verdrag wil verkrijgen maar vooral over de geldigheid van de handelingen en toegekende competenties aan de nationale rechters.
Hof van Justitie
De prejudiciële procedure is een samenwerking tussen de nationale rechter en het Hof van Justitie. Het Hof stelt hierover “(…) doch dat zulks niet geldt op het zeer bijzondere gebied van de door artikel 177 ingestelde rechterlijke samenwerking waarbij de nationale rechter en het Hof van Justitie (elk volgens hun eigen competentie) geroepen zijn om rechtstreeks en wederzijds bij te dragen tot het vinden van een beslissing waardoor de uniforme toepassing van het gemeenschapsrecht in alle Lidstaten wordt gewaarborgd".
Het Hof stelt verder “dat het de taak van het Hof is, bedoelde rechter rechtstreeks van voorlichting te dienen, zonder hem eerst te noodzaken zijn toevlucht te nemen tot zuiver dilatoire formaliteiten, welke met de eigen aard der in art. 177 geregelde procedure onverenigbaar zijn”.
De rechterlijke samenwerking geldt dus als basis voor de eenvormige toepassing van het communautaire recht.

Het Hof verwijst uitdrukkelijk naar de rechterlijke samenwerking als basis voor de eenvormige toepassing van het communautaire recht. De verhouding tussen het Hof van Justitie en de nationale rechter is in beginsel gekleurd door nevenschikking en samenwerking.
