Bewaring van gegevens (HvJ 10-02-2009, zaak C-301/06)
Casus
In deze zaak verzoekt Ierland om nietigverklaring van richtlijn 2006/24/EG van het Europees Parlement en Raad van de Europese Unie. Deze richtlijn betrof de bewaring van gegevens die zijn gegenereerd of verwerkt in verband met het aanbieden van openbaar beschikbare elektronische communicatiediensten of van openbare communicatienetwerken.
Ierland stelt dat art. 95 EG als onjuiste rechtsgrondslag voor richtlijn 2006/24 is gebruikt. Volgens Ierland kan art. 95 EG noch enige andere bepaling van het EG-Verdrag een passende rechtsgrondslag vormen voor deze richtlijn. Daarbij geeft Ierland aan dat het hoofddoel van de richtlijn bestaat in het vergemakkelijken van het onderzoeken, opsporen en vervolgen van ernstige criminaliteit, terrorisme daaronder begrepen. Zodoende zou de rechtsgrondslag voor de in deze richtlijn besloten liggende maatregelen alleen worden gevonden in titel VI van het EU-Verdrag. Bovendien zou de bewaring van persoonsgegevens in de door deze richtlijn vereiste mate leiden tot strijd met het bij art. 8 lid 2 EVRM bedoelde recht van particulieren op respect voor het privéleven. Het Parlement stelt op zijn beurt dat Ierland selectief is bij zijn lezing van de bepalingen van richtlijn 2006/24. Volgens het Parlement is het belangrijkste doel van de richtlijn het opheffen van de belemmeringen van de interne markt voor elektronische communicatie. Na de terroristische aanslagen van 11 september 2001 in New York, 11 maart 2004 in Madrid en 7 juli 2005 in Londen, hebben sommige lidstaten uiteenlopende regels vastgesteld met betrekking tot de bewaring van gegevens. Die verschillen konden het verrichten van elektronische-communicatiediensten belemmeren. De bewaring van gegevens is voor de aanbieders van openbaar beschikbare elektronische-communicatiediensten of communicatienetwerken een belangrijke kostenpost. Het bestaan van verschillende normen ter zake van die diensten kan de mededinging in de interne markt verstoren, wat zeer onwenselijk is. Volgens het Parlement heeft de richtlijn als voornaamste doel de harmonisatie van de verplichtingen die de lidstaten de aanbieders van diensten opleggen met betrekking tot de bewaring van gegevens. Zodoende acht het Parlement art. 95 wel als juiste rechtsgrondslag voor de richtlijn.
Conclusie
Het Hof heeft geoordeeld dat, gelet op de inhoud van de richtlijn, geconcludeerd moet worden dat die overwegend betrekking heeft op de werking van de interne markt. Bovendien heeft het Hof gesteld dat art. 95 de juiste rechtsgrondslag voor de richtlijn is. Zodoende werd het beroep van Ierland verworpen en werd Ierland verwezen in de kosten.
