Casus
Deze zaak betrof een beschikking van de Commissie betreffende de niet-opneming van Triclosan in de lijst van de Europese lijst van additieven, die kunnen worden gebruikt bij de vervaardiging van kunststof materialen en voorwerpen bestemd om met levensmiddelen in contact te komen. Het beroep is ingesteld door twee ondernemingen die het betrokken additief gebruikten voor de vervaardiging van hun producten. Als gevolg van deze beslissing van de Commissie, is het niet langer toegestaan om Triclosan gebruik in levensmiddelen. In het kader van gedelegeerde bevoegdheden is aan het besluit van de Commissie uitvoering gegeven.
HvJ
Het Hof geeft een definitie van "rechtstreeks geraakt', zoals vermeld in artikel 263 VWEU. Het Gerecht heeft geoordeeld dat het begrip “rechtstreeks geraakt”, zoals in het Verdrag van Lissabon omschreven, in ieder geval niet kan worden onderworpen aan een meer restrictieve interpretatie dan hetzelfde begrip, maar dan toegepast in de pre-Lissabon jurisprudentie.
Onder regelgevingshandeling in de zin van artikel 263, vierde alinea, VWEU is te verstaan alle handelingen van algemene strekking, met uitzondering van wetgevingshandelingen. Dienaangaande vormt een besluit van de Commissie betreffende de niet-opneming van een additief in een lijst van additieven, die overeenkomstig richtlijn inzake materialen en voorwerpen van kunststof, bestemd om met levensmiddelen in aanraking te komen, bij de vervaardiging van dergelijke materialen en voorwerpen kunnen worden gebruikt, een regelgevingshandeling in de zin van artikel 263 VWEU. De Commissie stelt dat besluit namelijk past in de uitoefening van uitvoeringsbevoegdheden en niet in de uitoefening van wetgevingsbevoegdheden. Dat besluit heeft bovendien een algemene strekking, in zoverre het van toe passing is op alle natuurlijke en rechtspersonen die zich bezighouden met de productie en/of verkoop van dit additief en van voorwerpen en materialen die deze stof bevatten, daar het van toepassing is op objectief omschreven situaties en rechtsgevolgen heeft voor een algemeen en in abstracto omschreven categorie van personen. Het verzoek was ontvankelijk. Het Hof vernietigde de beslissing.
