Casus
H. Krantz GmbH & Co is gevestigd in Aken (Bondsrepubliek Duitsland), dit is de ene partij, aan de andere kant staan de ontvanger der directe belastingen en de Staat der Nederlanden. Het geschil gaat over een beslag gelegd door de ontvanger op de invorderingen van ’s Rijks belastingen, gelegd op machines toebehorend aan Krantz. Deze machines zijn op afbetaling en met eigendomsvoorbehoud verkocht aan J.J. Krantz & Zoon NV, welke gevestigd is in Leiden. Krantz & Zoon heeft deze machines op hun beurt geplaatst in de fabriek van haar dochtervennootschap genaamd Vaalser Textielfabriek gevestigd in Vaals.
Krantz & Zoon en haar dochtermaatschappij zijn failliet verklaard. De ontvanger legde met het oog op de invordering van een belastingschuld van Vaalser Textielfabriek beslag op alle roerende goederen die zich in de Vaalser Textielfabriek fabriek bevonden. Krantz betoogt dat het beslag onverenigbaar is met het doel en de strekking van artikel 30 EEG-verdrag. Indien de bevoegdheid van de ontvanger van algemene bekendheid zou zijn, zouden verkopen op afbetaling naar Nederland sterk verminderen. De rechtbank in Maastricht vraagt zich af wat zij hier mee aan moet en stelt prejudiciële vragen aan het Hof.
Uitspraak
Volgens vaste rechtspraak, neergelegd in het Cassis de Dijon arrest, vormt iedere regeling die door intracommunautaire handel al dan niet rechtstreeks, daadwerkelijk of potentieel kan belemmeren, een maatregelen van gelijke werking. De nationale bepaling is zonder onderscheid van toepassing op binnenlandse en ingevoerde goederen en heeft niet tot doel, het handelsverkeer met andere lidstaten te regelen.
De mogelijkheid dat onderdanen van andere lidstaten minder snel goederen op afbetaling verkopen aan kopers in een andere lidstaat, omdat de ontvanger beslag zou kunnen leggen op de goederen wanneer de belastingschuld in Nederland niet wordt betaald, is te onzeker en indirect. Dit maakt dat men van een nationale bepaling die beslag mogelijk maakt niet kan zeggen dat zij handel tussen lidstaten belemmert.
Rechtsregel
Artikel 30 EEG-verdrag moet worden uitgelegd, dat het zich niet verzet tegen een nationale regeling krachtens welke de ontvanger der directe belastingen beslag kan leggen op goederen, terwijl die goederen afkomstig zijn en eigendom zijn van een leverancier uit een andere lidstaat. Kortom van de nationale bepaling die het recht geeft beslag te leggen kan niet worden gezegd dat zij de handel tussen lidstaten belemmert. Artikel 30 EEG-verdrag is niet geschonden.
