Corbeau (HvJ 19-05-1993, Zaak C-320/91)
Artikel 106 (lid 2) VWEU staat de lidstaten toe om aan ondernemingen die zij belasten met het beheer van diensten van algemeen economisch belang, alleenrechten te verlenen die de toepassing van de mededingingsregels van het verdrag kunnen belemmeren, voor zover beperkingen van de mededinging ‘of zelfs een uitsluiting van elke mededinging’ van andere marktdeelnemers ‘noodzakelijk’ zijn om te verzekeren, dat de houders van de alleenrechten de hun opgedragen bijzondere taak kunnen vervullen.
Het gaat dus om de vraag in hoeverre een beperking van de mededinging of zelfs een uitsluiting van elke mededinging van andere marktdeelnemers noodzakelijk is om de houder van het alleenrecht in staat te stellen, zijn taak van algemeen belang te vervullen en zulks met name onder economisch aanvaardbare omstandigheden.
Bij dit onderzoek moet worden uitgegaan van de premisse, dat de verplichting van degene die met die taak is belast, zijn diensten te verzekeren zonder daarbij het economisch evenwicht te verliezen, de mogelijkheid van compensatie tussen rendabele en minder rendabele sectoren van bedrijvigheid onderstelt en dus een beperking van de mededinging door particuliere ondernemers in de economisch rendabele sectoren rechtvaardigt.
Indien aan particuliere ondernemers zou worden toegestaan, de houder van de alleenrechten te beconcurreren in de aan die rechten beantwoordende sectoren van hun keuze, dan zouden dezen immers in staat worden gesteld, zich op de economisch rendabele activiteiten te concentreren en daarbij voordeliger tarieven te hanteren dan door de houders van de alleenrechten worden toegepast, aangezien zij, anders dan deze laatsten, niet economisch verplicht zijn de in de onrendabele sectoren geleden verliezen met de in de rendabeler sectoren gemaakte winsten te compenseren (kruissubsidiëring of: tegen gaan van ‘cherry picking’ of ‘cream skimming’).
De uitsluiting van de mededinging is echter niet gerechtvaardigd wanneer het gaat om specifieke, van de dienst van algemeen belang ‘dissocieerbare’ diensten, die beantwoorden aan bijzondere behoeften van de marktdeelnemers en een aantal bijkomende prestaties vergen.
